Tip Tuesday: Questions a Hearing Officer Should Answer

Hearing officers should try and answer the following questions in a disciplinary case:

  1. Was the employee on notice that his or her conduct could lead to disciplinary action? 
  2. Was the Company’s rule reasonable and necessary to the safe, orderly, and efficient operation of its business?
  3. Did the Company investigate the matter before imposing the disciplinary action and was the investigation conducted fairly?
  4. Was the Company’s rule applied consistently? 
  5. Was the degree of discipline imposed an appropriate penalty?
